In summary:
1. Dunstan Mlambo JP (now DCJ) corruptly manoeuvred one of his mistresses onto the Tribunal appointed to try Makhubele J in order to bias the Tribunal against her, in a matter in which their rival versions of events was in issue.
2. This mistress met none of the three essential qualifying requirements prescribed by the Judicial Service Commission Act to serve on the Tribunal, so her appointment was illegal, and the Tribunal that convicted Makhubele J was non-quorate.
3. A decade earlier, Mlambo JP had fixed his same unqualified mistress an appointment to the first Tribunal established to try his rival Hlophe JP (later removed), from which she promptly resigned after Hlophe JP's objection to her appointment on account of her 'inappropriate sexual relationship' with Mlambo JP (his exact words). Then-JSC Secretary Sello Chiloane recalled her resignation 'to avoid an unseemly scandal' (his exact words).
None of this concerns the merits of the GroundUp's complaint against Makhubele J regarding her conduct as chaiperson of the PRASA Board, concerning which Wayne Duvenage interviewed whistleblower Martha Ngoye in May 2025.
